Terms of service.

These general conditions govern and govern the contractual relationship (the "Contract") between Maria Datseris (the "Coach") and the Client for the provision of the services described below.. For the purposes of these General Terms and Conditions, "Client" means the person who requests the provision of the Services assuming the relevant obligations.

Subject of the Contract

The subject of the Contract is the provision to the Client, against Payment, of personalised coaching services (the "Services").

The Services will be provided directly by the Coach, with the methods specified below.

Services

Coaching is a process aimed at achieving the objectives defined with the Client. The activity of the Coach, which is developed through a process of analysing the Client’s difficulties and potentials, is designed to encourage self-reflections in the Client and to help him maximising his personal and professional potential. The aim of Coaching is to facilitate personal and/or professional development, developing strategies and tools for the achievement of personal and/or professional goals.

Relationship between Coach and Client

The coaching service involves the establishment of a professional relationship ("Partnership") between the Coach and the Client. As part of this relationship, the Coach is committed to maintaining standards of respect for the Client and the information that the Client chooses to share.

Moreover, the Dutch law WGBO (Geneeskundige Behandelovereenkomst) strengthens the Client’s position towards doctors, paramedics and other operators. This law requires:

  • Right to information

  • Need for a treatment agreement

  • Requirement to create a file with Client’s data

  • Client’s right of access to this file

  • Confidentiality about Client’s data

The Client is solely responsible for his state of psycho-physical well-being, as well as for his decisions, choices, actions and results produced by the coaching relationship and interactions with the Coach. Therefore, the Client agrees that the Coach is not and will not be guilty and liable for any action or inaction, or for any direct or indirect result of any service provided by the Coach. The Client understands that coaching is not a therapy service and does not replace it, if necessary, in any way: coaching does not prevent and cure any mental disorder or medically recognized disease.

The Client acknowledges that coaching includes various areas of the personal sphere, including: personal and professional life, finances, health, relationships, education, and others. The Coach has full freedom to decide how to manage topics related to these areas and how to incorporate the principles of coaching in them for personal improvement.

The Client acknowledges that coaching is not a service of diagnosis or treatment for mental illness, and that therefore coaching cannot replace any medical discipline related to the psycho-physical well-being of the individual (psychological therapy, counseling, psychoanalysis, and the like).

The Client is obliged to inform the Coach if he is also being treated by medical professionals in the psychological and psychotherapeutic field and vice versa.

The Client understands that, for an effective coaching relationship, it is necessary to communicate sincerely, to be open to advice and assistance. This is necessary to promote motivation and energy vital to the active participation on the Client in the coaching and training program.

Way of provision of Services

The Coaching service will be provided through direct individual sessions or virtual mode (via video-call) with the Coach depending on the agreement between Coach and Client during the intake session.

Sessions of 60 minutes will start on the day and at the time booked via the reservation. If the Client does not attend the session without having moved or booked it as indicated below, the session will still be considered as supplied.

The Client may freely cancel or move the booked session up to a maximum of 24h before the start time, by contacting the Coach by email or message.

If the appointment is not cancelled on time, the Coach has the right to charge the session’s costs to the customer (half of the normal price).

Duration and end of the coaching

The Coaching service will have a maximum duration of 6 months, unless specific agreements between Coach and Customer.

The end of the Service will be through a final session that can be followed by a Follow up session after 3 months.

Rates and methods of payment

The services covered by this contract will be provided by the Coach against the payment by the Client of the price indicated here and under the voice Rates on the website.

The customer is required to pay a fee of 50 Euro for each one hour session. Payment is made by bank transfer according to the conditions specified on the invoice that the Coach sends by email after each session.

Payment must be made within 14 working days from the date of issue of the invoice. In case of non-payment, a reminder will be sent to the Client. If the Client fails to make the deposit after a further 14 days, the Coach will charge an interest of 5% per month until the Client has completed the payment.

In case of late payment, the Coach has the right to suspend further processing until the Client has fulfilled the payment obligation.

Processing of personal data

The personal data of the Client will be processed by the Coach in compliance with the current Privacy Policy, as per the specific information made available on the website and provided by the Coach to the Client by email for viewing and signing.
